Terms and Conditions

By engaging our services, you agree to our Terms and Conditions Policy and also to our Damage and Liability Policy, Payment Policy, Cancellation and Rescheduling Policy, and Privacy Policy.

 

This Policy explains the terms and conditions under which The Lifting Lads ("we", "us", "our") provides moving and removal services. 

 

This Policy applies to all bookings made with us and is deemed accepted when a booking date and time are agreed verbally or in writing.

 

1. Services

We provide transport services for household goods, specialising in road freight transport and moving services.

 

2. Quotes and Pricing

2.1 Our standard rate is $150 per hour, which includes two (2) movers and one (1) truck.

 

2.2 A minimum charge of two (2) hours applies to all bookings.

 

2.3 Additional charges may apply for staircases, extremely heavy items, difficult or restricted access, or any conditions not disclosed at the time of booking.

 

2.4 Quotes and estimates are based on information provided by the customer and may be adjusted if information is inaccurate or incomplete.
 

3. Payment Terms

3.1 Payment is required in full upon completion of the job, and must be made before final unloading or before our movers depart.

 

3.2 We accept payment by bank transfer, card, or cash.

 

3.3 If payment is not made when due, we reserve the right to withhold goods until payment is received. We may exercise a contractual lien over goods for unpaid charges, in accordance with applicable law.

 

3.4 Where goods are withheld due to non-payment, it is the customer’s responsibility to collect the goods once payment has been made. Any costs associated with withholding or collection may be charged to the customer.

 

4. Cancellations and Rescheduling

4.1 Cancellations made with at least 24 hours’ notice are free of charge.

 

4.2 Cancellations made within 24 hours of the scheduled booking time will incur a two (2) hour minimum charge.

 

5. Customer Responsibilities

The customer is responsible for:

  • Providing accurate and complete information about the job, including item details, stairs, access, and distances

  • Ensuring clear, safe, and legal access for our vehicle and movers, including parking availability and permits

  • Ensuring items are properly packed and secured, unless packing services are agreed in writing

  • Disconnecting and preparing appliances prior to the move

  • Ensuring pets, children, and third parties do not interfere with the services

  • Ensuring all items are ready at the agreed start time

  • Advising us in advance of any fragile, high-value, or special-care items

  • Ensuring no prohibited or dangerous goods are included

 

6. Liability and Damage

6.1 We will take reasonable care when providing our services.

 

6.2 We are not liable for loss or damage arising from:

  • Pre-existing damage

  • Items packed by the customer

  • Fragile items unless declared in advance

  • Items that cannot be safely moved

  • Delays or issues outside our control

 

6.3 Our liability is limited unless additional insurance is arranged in writing prior to the job.

 

6.4 We are not liable for indirect or consequential losses, including loss of income, missed appointments, or business interruptions.

 

Nothing in these Terms excludes, restricts or modifies any rights or remedies the customer may have under the Australian Consumer Law which cannot be lawfully excluded.

 

7. Insurance

7.1 We maintain appropriate business insurance, including public liability insurance and insurance covering goods in care, custody and control while such goods are under our handling.

 

7.2 Our insurance covers clients’ property only while it is being handled, loaded, transported, unloaded, or placed, and only while the goods are under our care.

 

7.3 Coverage is subject to the terms, conditions, limits, exclusions, and excesses of our insurance policy. Coverage does not extend beyond what is provided under that policy.

 

7.4 We are not insurers of customer goods. Customers are encouraged to arrange additional insurance for high-value, fragile, sentimental, or irreplaceable items if they require coverage beyond the limits of our policy.

 

7.5 Our insurance does not cover:

  • Pre-existing damage

  • Normal wear and tear

  • Items not disclosed at the time of booking

  • Prohibited items

  • Loss or damage occurring outside the period of our care, custody and control

 

8. Delays and Force Majeure

8.1 We are not responsible for delays or failure to perform services due to circumstances beyond our control, including but not limited to traffic, accidents, road closures, weather conditions, vehicle breakdowns, access issues, customer delays, building restrictions, emergencies, or third-party actions.

 

8.2 Waiting time caused by customer delays, lack of access, unavailable keys, lift delays, or unprepared items will be charged at half (50%) of the standard hourly rate.

 

9. Prohibited Items

We do not transport the following items:

  • Dangerous or hazardous goods

  • Flammable or explosive materials

  • Illegal items

  • Perishable goods

  • Cash, jewellery, important documents, or valuables

  • Items not disclosed at the time of booking

  • Pianos

 

10. Right to Refuse or Stop Work

We reserve the right to refuse, pause, or stop work if:

  • The job is unsafe or poses a risk to people or property

  • Items are heavier, different, or undisclosed compared to what was agreed

  • Access conditions are unsafe or unsuitable

  • The customer is abusive, aggressive, or intoxicated

  • Payment terms are not being complied with

11. Claims and Complaints

Any claim for loss or damage must be reported in writing within twelve (12) hours of job completion. Claims made outside this timeframe may not be accepted.

 

12. Policy Priority

12.1 This policy overrides any assumptions, expectations, or verbal agreements regarding payment unless confirmed by us in writing.

 

12.2 Variations apply only where agreed by us in writing.

 

13. Amendments

We reserve the right to amend this policy at any time. Amendments apply only to future bookings.

 

14. Governing Law

These Terms and Conditions are governed by the laws of Western Australia.

 

15. Severability

If any part of this policy is found invalid or unenforceable, the remaining provisions remain in full force and effect.
